V. EXECUTIVE BRANCH:
a. President Kelly was not yet present, so Speaker Latino moved to Vice President Patent’s report.

b. Vice President Patent - introduced Ben Wright from Pueblo School for the Arts and Sciences to talk about creating a liaison between their student government and ASG. Mr. Wright reported on the activities of PSAS such as changing the scheduling so the students could take more college classes, an upcoming musical they will be performing, and ways to improve the relations between USC and PSAS. He stated that PSAS was also having difficulties with USC Today and some students who look down on the students in the program.
Senator Arellano suggested that they send some representatives to work with ASG on the Public Relations Committee.
Senator Wazir inquired about a letter that she suggested earlier to them, Mr. Wright responded that he would probably finish it by next week.
Speaker Latino asked if there were any more questions and thanked Mr. Wright for his comments.
Vice President Patent introduced the new Election Commissioner, Melissa Allen. Commissioner Allen reported on the staff she chose and mentioned that the Constitution stated that the commissioners needed to be in place by today. Senator Eden made a motion to vote immediately by secret ballot to accept all the candidates. Motion passed. The candidates were accepted.
Speaker Latino asked if there were any more questions. There were none. Since President Kelly was now present, Speaker Latino gave him the floor.

a. President Kelly reported that he had motel rooms reserved for the conference and that the rooms would be paid for when they check in. He said he received mail about internships called “The Capitol Experience” and anyone can sign up.
Senator Eden asked if they would be leaving the Friday before the conference or that Saturday.
President Kelly said he understood that they would be leaving on Saturday.
Dr. Hill said he had a van available and anyone who needed to get a travel advance needed to get that paperwork done.
Senator Arellano asked Dr. Hill to explain.
Dr. Hill explained the paperwork required for travel.

VI. LEGISLATIVE BRANCH:
a. Speaker Latino reported that the By Laws changes need to be finished by next Friday so persons can be assigned to work on the articles. She thanked everyone for the hard work on the Constitution and reported that it was nearly finished. She reminded everyone that these proposed changes will be put into amendment form and voted on. Speaker Latino asked how many of the senators wanted to make changes to the election code, specifically, the mail-out proposal. A majority responded. Speaker Latino requested at least four members form a committee to begin work on that project.
Dr. Hill stated that some of the forms for doing this type of mailing were used a couple of years ago, and that it will be easy to put this together.
Speaker Latino reminded committee chairpersons to get their reports in to her.
Fall Break Committee devised a survey and reported that 600 were surveyed and the majority favored a fall break.

b. Speaker Pro Tem Arellano gave his report - he checked the book lockers and found $7.50. He suggested that the senators drop a note into Speaker Latino’s box so there would not be so many adjustments made to the agenda. Also, there will be a meeting following the senate meeting to discuss the By Laws.

VII. COMMITTEE REPORTS
a. COFC - Speaker Pro Tem Arellano reported that the committee approved 3 re-charters: USC Art Club, One in Ten, and The Southern Association of Nursing. There was one allocation request for the Data Processing Management Association.
A representative from DPMA talked about forming a DPMA Chapter to benefit southeastern Colorado, the primary and secondary education levels, and computer information students by exchanging information and ideas with business professionals. Some of the funding will be from the club, DPMA is asking ASG for half of the funding needed.
Senator Eden asked how this would directly benefit the students of USC.
DPMA - It would bring in business people from the surrounding areas and give us opportunities to work with these businesses and members of the community on various projects.
Senator Latino asked for a vote to allocate $450.00 to DPMA. The measure passed.
Speaker Pro Tem Arellano stated that he would have a report next week on the amounts that have been funded through COFC.

b. Awards and Banquets - Senator Dupey reported the member of the month was Senator Jerry Pacheco.
Speaker Latino announced an Awards & Banquets meeting next Thursday (13).

c. PR Committee - Senators Matthys and Eden reported progress on the newsletter and a letter to the editor. Senator Eden and Senator Bridge put posters by the suggestion boxes. They are having a contest to name the newsletter.

d. Athletic Board - Senator Pacheco reported on the meeting held Jan. 29 at noon. There have not been any eligibility problems, and never have been at the current time. Sports Complex - the policies have been set, but there’s a problem with staffing. Some of the up-coming events are free clinics during girls in sports week. Feb. 7, 8, 9, there will be a baseball clinic on campus. Feb. 19 - Basket ball van bus to UCCS. NCCA meeting (National Convention to discuss policy) discussed the abuse of alcohol with coaches and officials. Anyone involved in the athletic program cannot bet on professional sports. Other concerns were athletes and drug and alcohol abuse, and reckless driving by student athletes in state vans. Speaker Latino asked about a contest that was held last year and if it would be held again. Senator Pacheco said he would look into it.

e. CSA - Senator Eden reported that the Legislative Breakfast will be held next week in Denver at the Capitol. She needs to know by tomorrow who is definitely going. They are leaving next Thursday and staying at a hotel so they won’t have to travel at 4 am to arrive in time for breakfast. So far, it’s Senator Dupey, Senator Matthys, Senator Wazir, Senator Bridge, Senator Percell.

f. Traffic Appeals - Senator Dupey reported there were 7 appeals granted, 14 denied and one no-show.

VIII. NEW BUSINESS
1. Senate Resolution # 970
Speaker Latino stated that this will be read and can be voted on today.
Senator Pacheco read the resolution.
Senator Arellano asked if this would pass to another committee and then Dr. Hill, if voted on and passed by ASG. He also asked Dr. Hill if he had the authority to extend the hours.
Dr. Hill explained that he works with an alcohol task force that came up with the guidelines, it used to be one o’clock, then it was changed, I would go back to that group for consideration.
Senator Arellano asked what the reason was that the time was backed off to midnight.
Dr. Hill answered that it was because of the concern for abuse of alcohol. I think it’s at a point where it can be reviewed.
Senator Matthys asked if the alcohol would stop being served at midnight to give the students an hour to sober up but still have the music playing.
Vice President Patent stated that campus policy says when you purchase your alcohol permit, it ends at midnight, regardless of how late your dance goes.
Dr. Hill said there were organizations that have continually abused the policies which caused the task force to be formed and address the problems. Also, the longer the length of time that alcohol is consumed, the greater the potential for problems.
Senator Cousar asked if there were a way to control the amount each student was able to consume by giving tickets and keeping track so that no one student could drink too much.
Parliamentarian Cook said that in the Student Activities Board in order to serve alcohol, you have to be TIPS trained. That'’s a 3 hourclass which teaches you how to recognize when people are drunk, and if so, you refuse to sell to them.
Senator Arellano asked Dr. Hill why those groups who were repeatedly violating the policy were allowed to continue with their events.
Dr. Hill said that they had discussed the need for a stronger disciplinary position. We've added that groups can be disciplined - instead of just individuals.
Senator Arellano said he would support this resolution if the task force would consider adding something that states that a person over 21 who showed up at an event already intoxicated, would not be allowed in, because that comes back on the organization who’s sponsoring the event
Senator Eden said one of the problems in the past has been organizations selling alcohol after the cut - off time and students purchasing tickets and not being able to use them, so why not have the ticket salespersons tell them that the last call time will only be a few minutes away.
Dr. Hill discussed the changes that have been made over time and stated that the idea is to make USC a fun place with a balance between fun and abuse. We don’t want to make USC a dull place. You're the voice of the students and I'’m concerned about the quality of events. Maybe we could put this in as a probationary status item and revoke it if it doesn'’t work.
Senator Arellano How did you come up with the one o'’clock time, has it ever been two o'’clock? You might have a lot of students saying cool, we can hang out here till 12:30 and then hit the bars. Some events are targeted for students in the residence hall, and if it ended at 2 AM, they could walk back to the dorms.
Senator Cousar Is there any way we can hold off on voting for this until we find out what some other organizations on campus feel?
Luke from USC Today asked if maybe the students were generally unaware of the policy for ending alcohol sales at midnight. If they were informed, they would know that they needed to be there at 11:00 in order to be wasted by midnight.
Vice President Patent said that another problem was that everyone shows up at 11:00 and it’s a mad dash to start slamming the beers like you said, but once everything is shut down, the students are still interested in doing things. If you extend the hours then at least the students are here in a safer environment. Then when they leave, they are more likely to go home.
Luke Can you extend the hours without serving the alcohol?
Vice President Patent We have to stop serving the alcohol at midnight, it’s a state law, the permit is only good till midnight and the next permit is not available until 11 AM the following day.
Senator Wazir I agree with Senator Arellano about extending hours to 2 AM instead of 1AM. I live on campus and there isn't'’t anything to do after midnight.
Speaker Latino If you want to change it, all you have to do is amend it.
Senator Eden moved to amend senate resolution #970, extending the time limit to 2 AM instead of extending the time to 1 AM. Motion passed.
Speaker Latino asked if there was any more discussion.
Senator Arellano moved to vote on senate resolution #970. Motion passed.
Roll Call Vote: Senator Dupey, yes; Senator Eden, yes; Senator Wazir, yes; Senator Arellano, yes; Senator Matthys, yes; Speaker Latino, abstain; Senator Martinez, yes; Senator Horner, yes; Senator Bridge, yes; Senator Percell, yes; Senator Derr, abstain; Senator Barrows, yes; Senator Pacheco, yes; Senator Cousar, yes.
Parliamentarian Cook announced that the resolution passed.
Speaker Latino announced the readings of Constitutional Amendments # 255, # 260, and # 265.
Senators Derr and Eden read the amendments.
Speaker Latino said those proposed amendments will be opened for discussion next week.

IX. AUDIENCE PARTICIPATION
Question from audience: I'M’m from USC Today, I would like to know what steps have been taken to ensure student participation in the search and screen for the new president ?
President Kelly: The State Board of Agriculture is the one who chooses the new president, they will be scheduling campus visits of all their candidates and along with that will be time set aside as there was with associate provost screen for student interview. Where they have an open forum. Any student who wants to come in and ask any questions.
Speaker Latino said the Senators made posters for the Associate provost candidates schedules and posted them around campus with dates and times and places that they were meeting, and they will do the same with the Presidential candidates.
Question from audience: Is there an ASG representative on the Presidential search and screen committee?
President Kelly: Yes, there are two students, Voncella Elliot, and Andy Phrem. They made their recommendation to the State Board on Tuesday. They are contacting the candidates to see if they are willing to have their names released.
USC Today: What are the circumstances and reasons behind forming the USC Today Committee?
Senator Arellano: It was suggested I talked to one of your former reporters about having a weekly meeting to talk to an ASG member. It wasn't’t done, so a committee was formed to keep USC Today informed and hopefully end some of this ASG bashing that has gone on during the first semester.
President Kelly: For example, we had a representative from USC Today at our Constitutional Convention and in the article it said “Possibly changing it to 15 Senators giving the total vote of 16.” That doesn’t add up unless possibly someone gets to vote twice. The next week we had a representative at our meeting and we spent maybe 45 minutes discussing possibly increasing the stipend for Speaker and Pro Tem and also what constitutes an open meeting. According to the paper, we spent the whole day discussing that. We spent a lot more time discussing other things.
Speaker Latino: Just to add to that, we’re just trying to get accurate information in the paper because during that By Laws Convention, it sounded like we spent 6 hours debating whether to close this meeting at 4 o’clock, and that was never debated. Closing this meeting was never discussed at all. What we have are post-senate meetings where we discuss personnel issues and by the Colorado Sunshine Law, we can have closed meetings for that reason. If we discuss anything else, that door is open to any student. However, that’s not what was reported in the paper. What was in the paper was that we were discussing closing this meeting, the 4 o’clock meeting, to the public. We spent over six hours working to make these documents (By Laws) more comprehensive for the students. I’m a Mass Comm Major and I understand that as an elected official, if we have conflicts going on that you need to report them, but we also do a lot of good that I don’t see reported. For example, the Fall Break. The reason we started the Fall Break Committee, is because in talking with a lot of students on campus, that was what one of their concerns was. They wanted a break to avoid the stress of no break (continuous classes) between August and November. That’s the whole point of us being here, to represent the student’s voice and that’s what we’re trying to do. I think there needs to be a balance between the negative and positive actions of ASG, and I think the committee can help with that.
Senator Arellano: You asked for other instances where that has happened. - the last article, I think it was by McNelly Nelly Torres, was completely inaccurate. You make it sound like were making a lot of money for the hours we put in, we don’t. The other that comes to mind is one that said, “In our opinion” I’I've spoken with Luke, and with Denton, you put in the paper, “In our opinion”. This is the only time I’I've seen the whole staff together, so how can it be, “In our opinion”? There was one reporter present, we had to adjourn because of personal problems with the old president being forced to resign, but Luke didn’t stay and ask questions. The paper came out the next week and it makes us look like clowns. Like we’re not accomplishing anything. All the positive things that were accomplished the first semester were never reported. The only time it was reported was when we as Senators wrote a letter and you put that, and you got it right because we wrote it.
USC Today: The reason we don’t send all our reporters is that’s when we have class from 4 to 6 PM every Thursday. Like any professional newspaper, we send one reporter to cover the meeting , and we trust that reporter to be accurate. True it does not always happen, but we are also learning just as you are. We make mistakes just like you do. That’s part of the problem, but what I’d like you to do, if you do create this USC Today committee, if one of us could be on it, we would appreciate it. If you have a problem, come to me, I’m the editor. I’m the one who knows what’s going on. I’m sorry that we can’t always be here. This afternoon we were able to ask our advisor and make it.
Speaker Latino: I think we understand that, but can you see that what we want is a balance?
USC Today: Yeah, I can understand that. You need to make an effort to let us know, there’s a lot of other stuff going on that we cover, we also have classes and other commitments.
Senator Derr: Another reason we’re setting up a USC Today Committee, it’s not necessarily how the paper reflects on us, it’s how you reflect the campus. There’s a lot of things we feel you don’t represent clubs on the campus, you don’t highlight them as much as you should, whereas, if one of your reporters is involved in something, they get a page. I think that’s a conflict of interest. And as to why students don’t know about one policy or another, you should print those in your paper so students are informed.
Senator Wazir: On a positive note, I wanted to really think whoever it was who reported the last article, I think it was Brandi, it was a very nice article and very accurate and goes to show that even though you are all students just like us, we as Senators have organized ourselves and we do get our information to each other even though we are very into our different committees, senate, and other activities. USC Today needs to organize themselves before you want us to get every point straight across to you. I think you need to make that effort to organize on your part.
Dr. Hill: I'’m the sponsor of ASG as you may or may not know just this year, and I’I've noticed over the years, really, there seems to have been an attitude or tone that has developed over time by the USC Today to what has been said today, to “bash ASG”. Now when you work as closely as I do, you would know that every one of these people is dedicated to serving the students of USC in the most honest and integrity manner that they possibly can, and I will say that unequivocally. Now, at the Constitutional Convention and By Laws Convention, two different reporters came. The accuracy of the reporting was, was, not accurate at all. One thing that I picked up on, the second reporter who came to the By Laws, is a comment that he said. “I can’t take things back to the USC Today that is positive, because it will be changed.” Now that really.. is this fairness? Is this a paper that is reporting accurately? With the exception of the last two weeks, and the reporter who has reported in the last two weeks is to be commended by the accuracy and integrity of her reporting.
Senator Eden: Maybe just a suggestion, if I go to a class and I want to make sure I get the professor’s words word for word and accurate, I’m going to take a tape recorder. Maybe, if you wanted to get accurate quotes and accurate information, maybe bring a tape recorder. That’s just a suggestion.
USC Today: First of all with that, I think we all know how to record with tape recorders. It think a lot of times when people do stories, they do quotes and sometimes people write what they say and other times say, I don’t understand that, and I want to get off that subject. You were talking about the good things you guys do and how we don’t report enough of it. Me personally, I don’t know much about ASG, I sometimes wonder what you guys do, but maybe you could just give us a run down on what you guys have done for us.
Senator Arellano: To start off, Rock the Vote. A number of senators gave up hours to post it on campus. Drove a bus down to the polling places for students who live in the residence hall. Got the Cubicle area renovated. Did a paint job on it, changed the ceiling tiles, cleaned the floors. Worked alongside Dr. Wong with the sexual harassment policy. Amended the Constitution and By Laws so there’s… I don’t want to say “loop holes”, that way, if it’s red, it’s red, and if it’s black, it’s black.
Speaker Latino: The Fall Break Committee. The Fall break that we'’re trying to get for students.
Senator Matthys: If you'’re interested in what each senator is doing, at every meeting following the senate meeting, unless there’s personality problems, it’s open. We talk about what each person is doing during office hours and what we are doing to improve the life for students on this campus. So, if you want to know, that’s a good way to find out as well.
President Kelly: To add in, got the Library Policy changed so that students can call in to renew their books instead of having to hand carry them in. Got that nice little sign removed from the Financial Aid office that said if anything you do here is objectionable, we can refuse service. The new book lockers that are in the Psychology Building and Life Sciences building. Money from them goes to the disabled student’s scholarship fund. And I did have one question, I'’I've been here three years and I've never seen a correction printed in the paper. Is that possible?
USC Today: Yes, in fact, there was a correction about 2 weeks ago. We incorrectly identified a person.
President Kelly: What did they have to do to get that corrected, because I've called over there and called over there and called over there and three weeks later, I get a return phone call.
USC Today: He called and then came over.
Speaker Latino: To add to that, besides all the outside stuff that we do, we represent the student’s voices on committees throughout the campus. We are the student’s voice and if we feel after talking with the students that something’s not right, then we tell them, no matter what committee it is. I’m not sure how many of you knew about the Financial Aid Forum that carried over into this semester even though it began last semester. 80% or more of the students of this campus are on some form of financial aid and were having all sorts of problems with financial aid office. As the student’s voice, we set up a Financial Aid Forum where we had our Interim Associate Provost there, the director of Financial Aid and others, and because of that forum, some changes were made.
Senator Wazir: I was speaking with PSAS and they had an article that was put in USC Today about some problems that I believe USC itself or faculty was having with PSAS. They wrote various letters in retaliation, there were also various telephone calls, and I can get copies of those letters if you want. They were never published and I’d just like to know was there a reason for those to not be published?
USC Today: We did not receive any letters.
Senator Wazir: Ben Wright, who is PSAS’s representative, has information on that if you would like to speak with him about it. He'’s right here.
USC Today: I wrote the article on PSAS, and I talked with Dr. Wong who said he was very pleased the students were here. I talked to the students who were very happy to be here. I did talk with some students who were very angry that PSAS was here (some comments here were too soft to be picked up on the tape) try to compromise…
Senator Wazir: With regards to the comment you just made about when you spoke to the students about PSAS, I spoke I believe it was last Friday, with the PSAS peer group counselors and the students and they said, Yes, you did speak to them, and that they were very thrilled to be asked for an interview by the newspaper. But what bothered them was that they made a small joke just like at our By Laws Convention, we made jokes back and forth that were taken as serious quotes. And they did not appreciate that.
USC Today: As anyone does who’s been interviewed by a reporter, they know that anything you say is part of journalism, unless they mention not to print it, but there wasn't…
Senator Wazir: Do you think that high school children understand that?
USC Today: I wouldn't call them children.
Senator Wazir: I mean, I call us children too, that'’s just my own phrase.
USC Today: I believe that they are old enough to understand and before I spoke to them, I mentioned that.
Ben Wright: Some of the things the students and myself are a little bit upset about. There was a cartoon in there, it had two very good caricatures that were supposed to be PSAS students and they were Kindergarten size and then there were two USC students who were towering above them and one said, “Well what’s USC stand for?” the other one said, “University of Small Children?”. That was one of them. Several quotes taken from PSAS students who were interviewed, were taken out of context. The whole article seemed very pessimistic, very much against us. That’s what offended us. Several parents wrote letters, several students wrote letters and sent them.
USC Today: Do you know where they sent them?
Ben Wright: I'll find out where they sent them, but as far as I've heard, they sent them to USC Today.
USC Today: Well, if you can find out where they were sent, we could get some copies, we'd really appreciate that
Ben Wright: I'll do that.
Senator Matthys: You mentioned when you are reporting, you quote anything, even if it’s a joke, and you call that journalistic ethics? That’s fine if when you graduate, you want to go and apply for a job at the Enquirer or the Star, but if you want to apply anywhere where they have journal ethics or academics or something you could read past the sixth-grade level that has ethics, I think you need to change your journal ethics.
USC Today: We have a set of professionally recognized guidelines.
Senator Matthys: Well, then maybe they better re-evaluate your ethics. If you think when someone’s joking around and it’s just a joke that you want to twist it and make it sound bad, then maybe you should re-evaluate them.
USC Today: Before we carry on shooting arrows at each other, I think we do realize that there is a problem and the fact that there needs to be better communication between the senators and USC Today, and we all agree with that, right? You guys have a PR Committee, right? So what you guys can do to make it really accurate and to make sure that we are doing our job and so that we can make sure and report accurately that you guys are doing your job and let students know the positive and the negative that’s going on campus, maybe you guys should get somebody from the PR Committee to start writing press releases, stuff you want in the newspaper, give us story items and leave it to us to come and get the feedback on that and then write the story on it.
Speaker Latino: Well, that'’s a good idea, and the whole thing about us wanting to set up the USC Today committee is that we will have a USC Today reporter there, because if we issue our own press releases, then I don't’think that’s very accurate because it’s coming from just us, it's better if we work together. That’s all were’re asking. I didn't’t mean for this to turn into a bash session when you first started asking questions. We're willing to work with you, now you just need to meet us half way.
USC Today: I just wanted to add that a number of times, I've called the student operator who is a student just like us, and I'’I have said can I get the ASG office. “What? ASG What?” They do know what ASG means and' I’m not saying that'’s your fault, so maybe you need to get the word out, and the other thing I want to add is, and this is not a negative comment, you should not'’t have the attitude that the student is going to come to you but maybe create some times, not just the office times, I know you are really busy, but maybe you can move into the grass roots and really let the students know who you are. I think the majority of students don'’t know who their senators are.
Speaker Latino: If you have any suggestions, we'd love to hear what their, because we've been to our colleges, we've set up tables that said “ASG Senators”. We've held individual forum from each college. We've held them in the Cantina, we've held them in the Hearthwell, we've held them all over and students don’t show up. I understand that we need to do stuff, but they need to meet us half way too.
Senator Arellano: We can discuss this all night and I'd be more than happy to do that, but there are people who have classes tonight. I want to thank you for showing up here today to help us in this first step and easing that tension. In regards to your saying that we need to get out, it would be so much easier for us to attract students if we weren't getting bashed week in and week out. If they knew that we were actually here accomplishing something, they'd be more willing to walk in that door.
USC Today: One thing that might help, I know that Nissa from CoPirg talks to classes, would it be possible to go to these and tell about who you are and what you do?
Senator Arellano: I agree with that idea, I've been involved with ASG, this is my 2nd year. Speech class giving speeches on ASG, writing papers on ASG, we have to read those papers in class. I've done that, speaking for myself. Students here on campus really don't like to get involved, it shows in the election turnout, it shows in the turnout we have for the forums, what people don't realize is that there's a lot of the senators up here that are taking full loads we have other lives than just ASG. We give a lot of hours to this and I don't know how much more is expected.
Speaker Latino: Are there any other comments?
Someone from the audience: I just wandering what was the purpose of the question in the survey about USC Today. I mean, I know there was a lot of people who got surveyed, but how did you go about deciding who got what survey and what was the distribution of that?
Senator Derr: The whole purpose of that survey. We only did a hundred surveys and it was during our office hour, it was basically for our own information of what students know and we surveyed students at the residence hall, the cantina, and the WANTS center. So it was just basically for our own information.
USC Today: Do you have a copy of those surveys?
Senator Derr: Yes, I have them all on file.
USC Today: I mean, just a blank one.
Senator Derr: Not with me.
USC Today: Do you have the results yet?
Senator Derr: Yes, I do.
USC Today: Could we get a copy of that?
Senator Derr: Yes.
Speaker Latino: Are there any more comments or questions?
